terms and conditions

  1. The offer is an unlimited evening and weekend data bundle (“the Offer”) and applies to all new pay monthly customers who connect to an Animal or Student Package before 30 June 2009 (the “Eligible Customers”).
  2. Automatic application of the offer for Upgrades & migrations is dependent on talkplan. To confirm whether your talkplan benefits from the offer automatically, consult your bill, call Customer Services on 150 or go to orange.co.uk/browsingterms.
  3. The Offer is subject to a 12 or 18 month minimum term contract as stated on your agreement with Orange. Notwithstanding clause 1 & 2 above, existing customers who are upgrading to other talkplans, need to request the Offer at the time you sign your new contract (and before 30 June 2009) or the Offer may not be applied to your account and you will remain liable for all data charges incurred.
  4. The Offer is unlimited evening and weekend WAP or mobile internet browsing on your mobile phone free of charge for two months, subject to clause 6 below. The Offer is for use within the UK only. You will be charged at your standard service plan rates for using your phone abroad.
  5. Fair usage policy: To ensure the fair allocation of network resources for all customers the Offer may not be used for: modem access for computers, internet based streaming services, voice or video over the internet, Instant Messaging, peer to peer file sharing and non Orange internet based video. If such use is detected, notice may be given and Network protection controls may be applied to all services which Orange does not believe constitute WAP or mobile internet browsing. This may result in a reduced speed of transmission, inability to use such services and, at the discretion of Orange, removal of the Offer. The Offer is subject at all times to a fair usage policy of 1000MB each month. Usage above this amount will constitute abuse & Orange may, at its discretion, monitor usage and withdraw the Offer from your account in the event that the fair usage policy is abused.
  6. Once the Offer is applied to your account you will continue to receive the Offer free of charge for 2 months. After this time you will automatically roll onto a £5 unlimited evening and weekend data subscription which you may cancel at anytime.
  7. If you have previously taken up the Offer and have rolled onto the £5 evening & weekend data subscription you are not eligible for an additional 2 months free on subsequent upgrades.
  8. The Offer does not include event charges such as for ringtones or games (although transport costs for these events are included) and can be used between 7pm and 7am, Monday to Friday and from 7 pm Friday to 7 am Monday. You will be charged at your standard service plan rates for using your phone outside these hours.
  9. For the avoidance of doubt the unlimited evening and weekend data bundle is an Orange Additional Service.
  10. Orange reserves the right to amend, vary, or cancel these terms and conditions or to withdraw the Offer on providing reasonable notice to you.
  11. In the event that your account is terminated for any reason, including, but not limited to non payment Orange reserves the right to refuse re-connection to the Offer.
  12. Service is subject to the Standard Terms and Conditions for the Supply of Orange Network Services, a copy of which can be found at the back of your Orange phone User Guide. Where there is any inconsistency between these Terms and Conditions, and the Standard Terms and Conditions for the Supply of Orange Network Services, the latter will prevail.
