  • "Channel" means a loop of or synchronous transition of Content that comprises part of the Package being subscribed for
  • "Compatible Handset" means the following 3G handsets: means the following 3G handsets: Nokia 6233, Nokia 6280, Nokia 6630, Nokia 6680, Nokia N70, Nokia N73, Nokia N80, Motorola V3x, Motorola e1070, Motorola C975, Samsung Z500, Samsung Z400, Samsung Z107, Sony Ericsson K610i, Sony Ericsson K800i, Sony Ericsson W850i, Sony Ericsson Z610i, Sony Ericsson M600i, Sony Ericsson P990i, Sony Ericsson W950i, Orange SPV M5000
  • "Eligibility Criteria" means that You must be a UK resident and an Orange UK pay monthly or pay as you go customer with a Compatible Handset and who subscribes for a Package.
  • "Orange" means Orange Personal Communications Services Limited, St James Court, Great Park Road, Almondsbury Park, Bradley Stoke, Bristol BS32 4QJ (Company number 2178917) who owns and operates a mobile telecommunications network (the "Network")
  • "mobile TV" means the TV service available by subscription by which channels comprising a Package of a type preselected by you may transmitted by Orange via the Network for viewing upon you initiating such transmission by selecting a channel to Your device (being a Compatible Handset)
  • "You" means any Orange account holder by Orange subject to Eligibility Criteria whose mobile device is registered to the Network and may be used to download or stream or otherwise access content including but not limited to television, video clips, images, games, applications, ring tones, icons, pictures, animations, sounds, picture postcards or other content for use on a mobile device (the "Content")
  • "Subscription Fee" means fee paid periodically in respect of the subscription You select.
  • "Package" means a specific grouping of Channels available together under a single Subscription Fee.
  • "Subscription Period" means the period that you pay the Subscription Fee to receive the Package or such other time as notified to You by Orange on reasonable notice.

By registering for mobile TV You agree to be bound by both these Terms and Conditions the Download / Access Terms and Conditions, the Terms and Conditions for the Supply of Orange Network Services and Orange's Privacy Policy.

You may stop your subscription to the Service at any time by unsubscribing from the Package and / or content Channels that You have subscribed to via the mobile TV management area at http://wap.orange.co.uk/r/otvaccount/

  1. These Terms and conditions are in addition to and subject to the Download / Access Terms and Conditions, Terms and Conditions for the Supply of Orange Network Services and the Orange Privacy Policy. In the event of any conflict these Terms shall take precedence.
  2. By registering for mobile TV and access, you are subscribing to a Package of Channels whereby Content may be viewed by you per Subscription Period. The Subscription Period will be automatically renewed until terminated in accordance with conditions 8 or 9. A new Subscription Fee will become due for each new Subscription period.
  3. Orange reserves the right to change the cost of the Subscription from time to time on reasonable notice. Any alteration or addition to the cost shall take effect immediately once posted on Orange World. Any continued access to content after such publication means You will be deemed to have accepted such changes.
  4. The Subscription Fee shall be payable in respect of each Subscription Period whether or not any Content is accessed.
  5. To unsubscribe by text message, text "OTV STOP" to 247 or go to http://wap.orange.co.uk/r/otvaccount/. The termination shall become effective immediately upon receipt by Orange of the termination request. Charges may appear on Your following month's bill in respect of Pay Monthly customers depending upon the date of the request.
  6. In the event that You have insufficient credit in Your account on the due date in respect of the Subscription Fee, Orange shall notify you. Orange shall periodically attempt to collect the Subscription Fee within 48 hours of the due date. In the event that the Subscription Fee is not collected within 48 hours your Subscription shall automatically lapse.
  7. Orange may cancel, vary or amend these Terms and Conditions at any time on reasonable notice. Where any variation detrimentally impacts Your rights under these terms and conditions, You may terminate Your participation within the Trial by giving Orange written notice within 7 days of the notification of the changes by Orange.
  8. You must only use Content for Your own personal use, and not for any commercial purpose. You agree to refrain from using the mobile TV Service (a) for the purpose of violating any applicable laws, rules or regulations issued or promoted by any competent government authority, including without limitation any intellectual property laws or export control laws restricting the transfer of certain technical data and software across international borders or to foreign nationals; (b) to violate or attempt to violate the security of any network, service or other system; (c) to transmit any materials of a threatening nature, including threats of death or physical harm, harassment, libel, or defamation; (d) to distribute offensive materials, including obscene, pornographic, indecent, and hateful materials; (e) for purposes of distributing "spam" or any other forms of mass unsolicited electronic communications; or (f) in a manner that interferes with any other user's ability to use the mobile TV Service or with Orange's or its suppliers' ability to provide the mobile TV Service.
  9. Breach of these Terms and Conditions by You will entitle Orange to terminate Your use of the Network and/or use of Content.
  10. The mobile TV Service pay as you consume tariff is charged on a per megabyte basis, dependant on the total amount of your TV viewing. This rate equates to a maximum rate of 40 pence per minute of viewing time. This rate may be slightly lower than 40 pence per minute on occasion, depending on network speed and fluctuations, but will not go above that rate.
  11. You must hold a current valid colour TV Licence in order to access all channels comprised within the mobile TV Service.
  12. If any of these Terms and Conditions are determined to be illegal or unenforceable by any court of competent jurisdiction such provision shall be determined to have been deleted without affecting the remaining provisions of the Terms and Conditions.
  13. These Terms and conditions shall in all respects be governed by and construed in accordance with English law and the parties hereby submit to the exclusive jurisdiction of the English Courts.
